This Liability Waiver and Assumption of Risk ("Waiver") is an agreement between BjjinDereham ("the Academy") and the participant named at signature ("you", or for a minor the parent or guardian signing on their behalf).

We are a non-discriminatory environment and encourage equal opportunities throughout training.

We strive to provide a safe training environment for you to enjoy your Brazilian Jiu Jitsu experience. However, please understand that Brazilian Jiu Jitsu is a full contact sport. We recommend complimenting your training with strength and conditioning.

By signing this membership waiver, you the member agree to the below.

1. Assumption of risk

Brazilian Jiu-Jitsu, grappling and related training are physically demanding contact activities that carry an inherent risk of injury, including bruises, strains, sprains, joint and muscle injuries, fractures and, in rare cases, serious injury. You understand these risks and take part voluntarily.

2. Medical fitness

You confirm that you are in good health and physically able to train, and that you have told the Academy about any medical condition, injury, allergy or pregnancy that may affect your participation. You agree to stop training and tell a coach immediately if you feel unwell or are injured.

All members must be aware that training with Bjjindereham is classified as strenuous physical activity. Before undertaking any type of physical activity you are advised to contact your GP. The Tōukon Academy™️ Norwich nor any of its coaches can be held responsible for any injuries sustained during training.

Health Questionaire

1. Do you have chest pain or respiratory issues when performing physical activity? YES/NO

2. Are you pregnant or have you given birth in the last 6 months? YES/NO

3.Have you recently suffered a head injury (knocked unconscious, fracture)? YES/NO

4. Do you have any other limitations that must be addressed or made aware of ( diabetes, high blood pressure, high cholesterol, arthritis, back problems, recent surgery etc.)? YES/NO

I hereby confirm that I can answer no to Q1-3 the above questions about my health and made BjjinDereham aware of any health concerns on my membership form.

I hereby confirm that I will make BjjinDereham aware of any changes to my health and will consult my GP to get permission to exercise when required.

3. Release of liability

To the fullest extent permitted by law, you release the Academy, its owners, coaches, staff and members from any claim for injury, loss or damage arising from your participation, except where caused by gross negligence or wilful misconduct. Nothing in this Waiver excludes liability that cannot be excluded by law.

4. Rules and safety

You agree to follow the Academy's rules, the instructions of its coaches, and the Code of Conduct. You will train in a controlled way, respect your training partners, and release ("tap") to submissions promptly.

Hygiene

Brazilian Jiu Jitsu is a contact sport thus hygiene is important. If you have any transmittable infection, please seek medical advice and do not train until this has passed e.g. a skin infection.

Please ensure you arrive with clean training attire and well groomed (toe/finger nails).

We work hard to keep the training environment clean, please follow the rules relating to this.

Training Attire and Safety Equipment

You are welcome to wear any Jiu Jitsu gi you like, providing it is well maintained and appropriate for the training we are doing.

No jewellery to be worn during training.

We recommend wearing a gum shield whilst training

5. Minors

If you are signing for a participant under 18, you confirm that you are their parent or legal guardian and accept this Waiver on their behalf.

6. Photography and media

The Academy may occasionally photograph or film classes and events to promote the club. Please tell a coach in writing if you do not wish to appear.

7. Governing law

This Waiver is governed by the laws of the United Kingdom. If any part of it is found to be unenforceable, the remaining parts continue to apply.

By signing, you confirm that you have read, understood and agree to this Waiver.

3e:Ta93,

These Terms set out the agreement between Bjjindereham ("the Academy", "we" or "us") and you when you become a member or train with us. Please read them carefully.

1. Membership

Your membership begins when we confirm your enrolment and continues until it is cancelled in line with these Terms. Membership is personal to you and cannot be transferred to anyone else. Members must give atleast 7 days notice before cancelling membership (unless it is a trial month membership).

2. Fees and payment

Membership fees are billed [monthly / your billing period] in advance using the payment method on your account.
You are responsible for keeping your payment details up to date.
Drop-in and one-off session fees are payable before or at the time of the class.

3. Cancellation and notice

You may cancel your membership. Fees already paid for the current period are non-refundable except where the law requires otherwise.

4. Pausing and changes

You may ask to pause your membership in the circumstances we allow (for example injury or travel) by contacting us. We may change classes, timetables, fees and these Terms from time to time, and will give you reasonable notice of any material change.

5. Booking and attendance

Some classes need to be booked in advance. Please cancel a booking you can no longer attend so the space can be offered to another member.

6. Conduct and safety

By training with us you also agree to our Liability Waiver and Code of Conduct. We may refuse entry to, suspend or terminate the membership of anyone whose behaviour puts others at risk or breaches these Terms.

7. Your information and privacy

We collect and use the personal information you give us (such as your contact, billing and attendance details, and any medical information you choose to share) only to run your membership and the Academy. We keep it secure, never sell it, and share it only with the providers that help us operate (for example our payment provider and class-management software). You can ask to see, correct or delete your information by contacting us at [contact email]. [Reference your local data-protection law here, for example the UK GDPR or your US state's privacy law.]

8. Liability

Nothing in these Terms limits any liability that cannot be limited by law. Otherwise our liability to you is limited as set out in the Liability Waiver.
